This Privacy Policy explains how Forge Movement LLC, a Connecticut limited liability company (“Forge Movement,” “we,” “us,” or “our”), collects, uses, discloses, and protects information when you access or use the Forge Movement exercise-selection mobile application, website, software, content, features, and related services (collectively, the “App”).
The App is designed to help users identify, select, and organize exercises and related fitness or movement information. The App is not a substitute for medical advice, diagnosis, treatment, physical therapy, rehabilitation, or care from a physician, physical therapist, or other qualified medical professional.
By accessing or using the App, creating an account, clicking to accept, or otherwise indicating assent, you acknowledge that you have read and understand the App’s Terms of Use, which are hereby incorporated by reference, this Privacy Policy and consent to the collection, use, disclosure, and other processing of information as described in this Privacy Policy where consent is required by applicable law. If you do not agree with this Privacy Policy, do not access or use the App.
Scope of this Privacy Policy
This Privacy Policy applies to information we collect through the App and related online services that link to this Privacy Policy.
This Privacy Policy does not apply to information collected, used, disclosed, stored, secured, or otherwise processed by third-party websites, applications, platforms, devices, services, or integrations that we do not own or control, even if the App links to or integrates with them. Third-party services may have their own privacy policies and practices.
Unless we expressly state otherwise in a separate written agreement, Forge Movement is not a HIPAA-covered entity or HIPAA business associate solely by making the App available, and information submitted through the App is not monitored in real time by a medical professional or treated as a request for medical care, clinical services, or emergency assistance. If you use the App in connection with a separate health care provider, physical therapist, clinic, employer, insurer, or other third party, that third party’s own privacy practices and legal obligations may apply separately.
Information We May Collect
We may collect the following categories of information, depending on how you use the App and which features are made available.
Account and Contact Information
We may collect information such as your name, email address, username, password or authentication credentials, phone number, mailing address, age or date of birth where needed to verify eligibility or obtain required consent, and other information you provide when creating or managing an account, contacting us, or receiving support.
Profile, Fitness, Movement, and Health-Related Information
The App may allow you to provide information related to your exercise preferences, goals, activity information, symptoms, limitations, injuries, pain points, mobility, strength, flexibility, physical restrictions, exercise history, progress, or other information relevant to selecting or organizing exercises.
This information may be personal and sensitive. Depending on your location and how the information is used, some of this information may be considered health-related information, consumer health data, or similar sensitive information under applicable law.
App Use and Activity Information
We may collect information about how you use the App, including selected exercises, saved exercises, completed exercises, favorites, settings, feature usage, session activity, in-app interactions, preferences, and related usage data.
Device, Technical, and Online Activity Information
We may collect technical information such as device type, operating system, browser type, IP address, device identifiers, app version, language settings, time zone, crash logs, diagnostic data, log files, referring pages, pages or screens viewed, dates and times of access, and similar technical or analytics information.
Location Information
We may collect general location information, such as approximate location derived from your IP address. We will not collect precise geolocation information unless the App provides a feature that requires it and you authorize the collection through your device or app settings.
Payment and Subscription Information
If paid features, subscriptions, or in-app purchases are offered, payment information may be processed by an app store, payment processor, or other third-party payment provider. We may receive limited transaction information, such as subscription status, payment confirmation, purchase history, or billing contact details. We do not intentionally collect or store full payment card numbers, except to the extent a payment provider makes such information available to us.
Information from Third Parties or Integrations
If you choose to connect the App with a third-party service, wearable device, fitness tracker, health platform, app store, authentication provider, or other integration, we may receive information from that third party as authorized by you and permitted by the third party’s terms and settings.
You should review the privacy settings and policies of any third-party service before connecting it to the App.

You, when you create an account, enter profile information, select exercises, use App features, contact us, or otherwise provide information.
Your device, browser, or app environment, including technical and usage information generated when you use the App.
Third-party services, if you choose to connect or interact with them through the App.
Service providers, such as hosting, analytics, support, security, payment, communications, or app operations vendors.
How We Use Information
We may use information for the following purposes:
To provide, operate, maintain, and improve the App.
To create, manage, authenticate, and secure user accounts.
To help users identify, select, organize, save, or track exercises and related movement information.
To personalize App features, settings, content, and user experience.
To respond to questions, requests, and support inquiries.
To send service, transactional, administrative, security, and account-related communications.
To analyze App performance, usage, reliability, errors, and feature engagement.
To develop, test, improve, and troubleshoot the App and related services.
To protect the security, integrity, and availability of the App.
To detect, investigate, prevent, or respond to fraud, misuse, unauthorized access, policy violations, legal claims, or other harmful activity.
To comply with legal obligations, respond to lawful requests, establish, exercise, or defend legal claims, enforce our Terms of Use, and protect our rights and the rights, safety, and security of others.

Health-Related Information and Consumer Health Data
Because the App relates to exercise, movement, fitness, physical limitations, symptoms, and related information, some information collected through the App may be considered sensitive health-related information under applicable law.
Where required by applicable law, we will collect, use, or disclose health-related information only:
as necessary to provide the App or a feature you request;
as described in this Privacy Policy or a supplemental notice;
with your consent or authorization; or
as otherwise permitted or required by law, including to establish, exercise, or defend legal claims and to protect rights, safety, and security.
The App does not provide medical advice, diagnosis, treatment, physical therapy, rehabilitation, or emergency care. Information you provide through the App should not be used to delay seeking medical advice or treatment from a qualified medical professional.
Washington Consumer Health Data Notice
This section applies to the extent the Washington My Health My Data Act applies to information processed by Forge Movement.
Categories of Consumer Health Data We May Collect
Depending on how you use the App, we may collect the following categories of consumer health data:
exercise goals, preferences, and selected exercises;
activity, movement, mobility, strength, flexibility, balance, or performance information;
symptoms, pain information, physical limitations, injuries, restrictions, or other health-related self-reported information;
information about exercise history, progress, completion, or modifications;
information from connected devices, fitness trackers, or third-party health or fitness platforms, if you choose to connect them;
information that may identify you as seeking exercise, movement, wellness, or health-related services or information; and
other information you choose to provide that is linked or reasonably linkable to your physical or mental health status.
Purposes for Collecting Consumer Health Data
We may collect consumer health data for the following purposes:
to provide the App and exercise-selection features you request;
to save, organize, display, or personalize exercise information;
to help you track preferences, activity, progress, or related App use;
to maintain, secure, debug, and improve the App;
to respond to support requests and user communications;
to comply with law, enforce our Terms of Use, and protect rights, safety, and security; and
for other purposes disclosed to you with your consent.
Sources of Consumer Health Data
We may collect consumer health data from:
you;
your use of the App;
your device or connected technologies;
third-party services or integrations you authorize; and
service providers that support App operations.
Sharing of Consumer Health Data
We may share consumer health data only as described in this Privacy Policy, as necessary to provide the App or a requested feature, with processors or service providers acting on our behalf, with your consent where required, or as otherwise permitted by law.
We may share consumer health data with the following categories of recipients:
hosting, infrastructure, storage, security, and technical service providers;
analytics, diagnostics, crash reporting, and performance service providers, where permitted by law;
customer support and communications service providers;
payment processors or app stores, if paid features are offered;
third-party integrations you choose to connect;
professional advisers, legal representatives, auditors, insurers, and similar business advisers;
government authorities, courts, regulators, law enforcement, or other parties where required or permitted by law; and
parties involved in a corporate transaction, such as a merger, acquisition, financing, reorganization, or sale of assets, subject to applicable law.
We do not sell consumer health data or share consumer health data with advertising networks or data brokers for targeted advertising unless we provide any legally required notice and obtain any legally required consent or authorization.
Consent for Collection and Sharing
Where required by law, we will obtain your consent before collecting consumer health data for purposes other than those necessary to provide a product or service you request.
Where required by law, we will obtain consent that is separate and distinct from consent to collect before sharing consumer health data.
You may withdraw consent where required or permitted by law by using available App settings or contacting us at john@forge-movement.com. Withdrawal of consent may affect the availability or functionality of certain App features.
Sale of Consumer Health Data
We do not intend to sell consumer health data. If we propose to sell consumer health data in a way that requires authorization under applicable law, we will obtain any required authorization before doing so.
Consumer Rights
Subject to applicable law and verification, you may have rights to:
confirm whether we collect, share, or sell your consumer health data;
access your consumer health data;
receive a list of third parties and affiliates with whom we have shared or sold your consumer health data, where required by law;
withdraw consent for collection or sharing;
request deletion of consumer health data; and
appeal a decision we make regarding your request, where required by law.

How We Disclose Information
In addition to the consumer health data disclosures described above, we may disclose personal information as follows:
Service Providers: We may disclose information to vendors, contractors, and service providers that perform services for us, such as hosting, storage, analytics, security, payment processing, customer support, communications, and technical operations, and we require them to process personal information only for authorized purposes and subject to appropriate confidentiality and security obligations where required by law or contract.
Third-Party Integrations: If you choose to connect the App with a third-party service, we may disclose information as necessary to enable the integration, subject to your settings and consent where required.
Legal and Safety Purposes: We may disclose information if we believe disclosure is necessary or appropriate to comply with law, legal process, or government requests; protect rights, safety, or security; prevent fraud or misuse; or enforce our Terms of Use.

Cookies, Analytics, and Similar Technologies
The App and related website may use cookies, software development kits, pixels, local storage, analytics tools, crash-reporting tools, and similar technologies to operate the App, remember preferences, analyze usage, improve performance, diagnose errors, maintain security, and support App functionality.
If we use third-party analytics or similar tools, those providers may collect information about your device, interactions, and usage, but we will not knowingly configure such tools to collect consumer health data for targeted advertising without any legally required notice, consent, or authorization. We will evaluate such tools for consistency with this Privacy Policy and applicable health-data privacy requirements.
You may be able to manage cookies and tracking technologies through your browser, device, or app settings. Disabling certain technologies may affect App functionality.
Data Security
We use reasonable administrative, technical, and physical safeguards designed to protect information from unauthorized access, use, disclosure, alteration, or destruction. However, no method of transmission, storage, or processing is completely secure, and we cannot guarantee absolute security.
You are responsible for maintaining the confidentiality of your account credentials, promptly notifying us of any suspected unauthorized access, and using appropriate safeguards when accessing the App.
Data Retention
We retain information for as long as reasonably necessary to provide the App, maintain your account, comply with legal obligations, resolve disputes, establish, exercise, or defend legal claims, enforce agreements, maintain security, prevent fraud or misuse, and fulfill the purposes described in this Privacy Policy.
Retention periods may vary depending on the type of information, the purpose of processing, legal requirements, and operational needs. We may retain deidentified, aggregated, or anonymized information where permitted by law.
Health Breach Notification
If Forge Movement is required by applicable law to provide notice of a breach involving unsecured identifiable health information or consumer health data, we will provide notice to affected individuals, regulators, and other parties as required by applicable law.

Children’s Privacy
The App is not intended for children under 13 years of age, and children under 13 may not create an account or use the App unless we expressly make a child-directed feature available and obtain legally required verifiable parental consent.
If you believe a child under 13 has provided personal information to us, please contact us at john@forge-movement.com, and we will take appropriate steps to delete the information where required by law.
Your Choices and Privacy Rights
Depending on your location and applicable law, you may have the right to request access to, correction of, deletion of, or portability of certain personal information. You may also have the right to withdraw consent, object to certain processing, restrict certain uses, or appeal a decision regarding your request.

We may need to verify your identity and authority to act on behalf of another person before processing your request, and we may deny or limit requests where permitted by applicable law. We will respond as required by applicable law.
You may also be able to update certain account information or preferences through the App settings.
Communications Preferences
We may send you service, transactional, account, security, and administrative communications. These communications are part of the App and you may not be able to opt out of them while maintaining an active account.
If we send marketing communications, you may opt out by following the unsubscribe instructions in the communication or by contacting us. Even if you opt out of marketing communications, we may still send non-marketing communications related to your account or use of the App.
Deidentified or Aggregated Information
We may create or use deidentified, anonymized, or aggregated information that does not identify you and is not reasonably linkable to you, and we may retain and use such information without restriction except as required by applicable law. We may use and disclose such information for lawful business purposes, including analytics, research, product improvement, reporting, and development. We will not attempt to reidentify deidentified information except as permitted by law, such as to test or validate deidentification methods.
Third-Party Links and Services
The App may contain links to third-party websites, applications, platforms, devices, or services. We are not responsible for the privacy practices, security practices, or content of third parties. If you choose to use a third-party service, your information may be subject to that third party’s privacy policy and terms.
International Users
Forge Movement is based in the United States. If you access the App from outside the United States, you understand that your information may be processed and stored in the United States or other jurisdictions where privacy laws may differ from those in your location.
Changes to this Privacy Policy
We may update this Privacy Policy from time to time. If we make material changes, we may notify you through the App, by email, by posting an updated policy, or by other reasonable means.
